, . Sec.13.04 RIGHTS OF SUBJECTS OF DaT,� Subd. 1. Type of data. The righcs of individual on whom the data is stored or to be stored shall be as set forth in this secdon. Subd.2. Informadon reqtrired to be given individual. ,0.n individual asked to supply privace or confidenaal dara concerning himself shall be informed of: (a)the purpose and intended use of the requested data within the collecdng'state agency,poliacal subdivision,or sratewide system; (b)wherher he may refuse oY is legally required to supply the rtquested data;(c)any lmown coasequence arising from his supplying or refusing to supply priva[e or conndential data;and(d)the idenrity of other persons or enndes authorized by state or federal law to receive the data. This requiremen[shall not apply when an individual is asked to supply invesogaave dard, pursuant to secaon 13.82, subdivision 5, to a law enforcement o�cer. The commissioner of re��enue mav place the noace rewired under this subdivision in the individual income tax or propem tax refund instructions insczzd of on those forms. Subd. 3. Access to data by individual. Upon request to a responsibfe authoriry,an individual shall be informed whether he is the subject of stored data on individuals,and whecher it is efass�ed u public, private or confidendal. Upon his further requesc, an individual who is the subjecc of stored private or public data on individuals shall be shown�he data wichout any charge to hun and, if he desires, shall be informed of the contenc and meaning of that data. Ahzr an individual has been shown the private data and informed of irs meaning, che data need not be disclosed to him for six months thereafter unless a dispute o�acdon pursuant to �his secrion is oending or addidonal data on the individual has been collected or created. The responsible auehoriry shali provide copies of[he privace or public data upon request by the individua!subjecc of the data. The responsible au[horiry may require the requesring person to pay the actual costs of making,cerrifying,and compiling the copies. The responsible au[horiry shall comply immedia�ety, if possible, wi�h any request made pursuant to this subdivision, or within five days of the date of the request,excluding Saturdays,Sundays and legal holidays,if immediate compliance is not possible. If he cannot comply with the request within that time,he shall so inform[he individual,and may have an addidonal five days wirhin which to comply wich the request,excluding Saturdays, Sundays and legal holidays. Subd.4. Procedure when data is not accurate or complete. An individual may contest the accuracy or completeness of public or prn•ate data eoncerning himself. To exereise chis righ[,an individual shall norify in wri[ing the responsible au[horiry dzscribing[he nacure of the disagreemeot. The responsible authoriry shall within 30 days ei�her: (a)correct che data found to be inaccurate or incomplete and attempt to nodfy past recipienrs of inaccunte or incomplete data, including recipients named by rhe individual; or(b)noufy the individual that he believes the data ro be correct. Data in dispute shall be disclosed only if[he individual'S statemenc of disagreement is included wi[h the disclosed data. The de�erminanon of the responsibie authoriry may be appealed pursuant ro the provisions of the administrxdve procedure act relaring to contested cases.
