� O� <br /> O � 4 <br /> �'��a��=� CITY of ORONO <br /> � � n��� ti <br /> v' `� '�' RESOLUTION OF TH����UNCIL <br /> ���kESH04�G NO. <br /> A RESOLUTION GRANTING VARIANCES <br /> TO MUNICIPAL ZONING CODE <br /> SECT1rJN 78-1405 <br /> FILE N�. 09-3421 <br /> WHEREAS, James Neve and Jacqueline Neve, husband and wife (hereinafter <br /> "the applicants") are the owners of the property located at 4060 Dahl Road within the City of <br /> Orono (hereinafter the "City") and legally described as follows: <br /> � Lot 16, Block 1, Pirates Cove, Hennepin County, Minnesota (hereinafter the <br /> "property"); and <br /> WHEREAS, the applicants have made application to the City of Orono for a <br /> variance to Orono Municipal Zonin� Code Section 78-1405 to allow a 10' x 12' garden shed to <br /> be located 2.4' from the side lot line where a 10' setback is required. <br /> NOW, THEREFORE BE IT RESOLVED by the City Council of Orono, <br /> Minnesota: <br /> FINDINGS <br /> 1. This a,�plicatian was revi�wed as Zor�inj File 09-3��1. <br /> 2. The property is located in the LR-1B One Family Lakeshore Residential Zoning <br /> District which requires a minimum lot area of 1.0 acre and a minimum lot width <br /> of 140'. <br /> 3. The Planning Commission reviewed this application at a public hearing held on <br /> August 17, 2009, and recommended approval of variances based on the following <br /> findings: <br /> a. The property is conforming in area and width and contains 43,480 s.f. in area <br /> and has 160' at the OHWL and 145' at the 75' setback. <br /> b. The hardcover levels as proposed are in conformance with Cify Code Section <br /> 78-1288 regarding Hardcover and the residence and garden shed meet the <br /> structural lot coverage limitation of 15%. <br /> Page 1 of 4 <br />
