Hall,Applicant,was present. <br /> The Certificate of Mailing and Affidavit of Publication were noted. <br /> Weinberger indicated the City Council has requested this matter be returned to the Planning <br /> Commission to discuss options on the property for deck replacement without increasing the <br /> size of the deck. The Planning Commission at their last meeting had voted 7-0 to recommend <br /> denial of the request based on the size of the deck located within the 75' setback would <br /> increase. <br /> The Applicant is requesting an after-the-fact variance to permit replacement of a deck within <br /> the 75' setback to a protected tributary. Weinberger stated the issue at the previous Planning <br /> Commission meeting was the fact that additional structure was to be placed within 75' feet of <br /> the tributary. <br /> S Weinberger stated the Applicant has revised his plans, with the size of the deck now proposed to <br /> remain the same as the existing amount of hardcover within 75' of the tributary. The Applicant <br /> has agreed to reduce a portion of the deck so the hardcover within 75' of the tributary would not <br /> increase. Weinberger stated the total amount of hardcover prior to the reduction was 174 square <br /> feet within 75' of the tributary,with the revised plan proposing 170 square feet within 75' of <br /> the protected tributary. Weinberger noted a portion of the deck would be constructed outside <br /> the 0-75' setback. <br /> City Staff is recommending approval of the revised application. <br /> Hall indicated he had nothing further to add to Staffs report. <br /> There were no public comments regarding this application. <br /> Nygard moved,Berg seconded,to recommend approval of Application#2610,Jerome J. <br /> Hall,80 Leaf Street,granting of an after-the-fact variance to permit replacement of a <br /> deck within the 75' setback to a protected tributary.
