Weinberger stated the <br /> issue before the Planning Commission is whether the platting of this road within the development <br /> is appropriate. <br /> Smith commented that what is being proposed makes sense, noting she is sympathetic to the <br /> landowners that could potentially be landlocked unless easements are provided up to this new road. <br /> Weinberger stated the property owners would need to obtain private easements from the other <br /> property owners to gain driveway access. <br /> Smith noted that Lot 4545 would need to obtain an easement from Lot 4555. <br /> Weinberger stated they currently do have easements over a portion of that lot, but would be required <br /> to obtain additional easements all the way across to Town Line Road prior to the road construction. <br /> Smith commented that there appears to be a 20 foot easement already in place connecting to the <br /> new road. <br /> Slaughter stated there also is a 33 foot easement that exists. <br /> Weinberger stated there is documentation showing almost overlapping easements which would <br /> provide access back to the property as well. Weinberger stated there apparently is a cartway which <br /> • exists in this area, which has never been legally recorded and was never used. Weinberger stated <br /> there is a 33 foot easement from 1910 which could provide driveway access as well. <br /> Berg inquired what easement Slaughter intends to use, the cartway or the 33 foot easement. <br /> Slaughter stated she would use the easement along Town Line. <br /> Lindquist stated the Planning Commission is simply approving that section of road that is being <br /> proposed tonight and does not really have any jurisdiction to hear any other issues relating to <br /> easements or the railroad access. <br /> Smith commented that there appears to be some options for the property owners relating to access, <br /> but noted the Planning Commission is not in a position to hear those matters at this time. <br /> There were no further public comments regarding this application. <br /> Lindquist moved, Smith seconded, to recommend approval of Application#2587, <br /> 4575 Wayzata Boulevard, Subdivision for Platting a Public Road Adjacent to a Proposed <br /> Six Lot Plat Located in the City of Medina, subject to the seven conditions contained in the <br /> May 15, 2000 Planner's Report.
