MINUTES OF THE <br />ORONO CITY COUNCIL MEETING <br />Monday, April 11, 2011 <br />7:00 o'clock p.m. <br />_____________________________________________________________________________________ <br /> <br /> Page 12 of 30 <br /> <br />(6. #11-3501 YOUR BOAT CLUB, LLC, 1444 SHORELINE DRIVE, Continued) <br /> <br />Bremer moved, Rahn seconded, to adopt Resolution No. 6037 granting a conditional use permit, <br />approving 20 boat club slips and subject to the other conditions outlined in the resolution for <br />Application No. 11-3501, Your Boat Club, LLC, 1444 Shoreline Drive. <br /> <br />Gaffron asked if there are any other changes or additions the Council would like to make to the draft <br />resolution. <br /> <br />McMillan asked if the parking needs to be spelled out. <br /> <br />Mattick stated the easement is fine for the additional parking. <br /> <br />Gaffron noted the easement is covered under Item No. 1. <br /> <br />McMillan asked if the resolution covers the situation where the easement goes away. <br /> <br />Mattick stated if those residential properties were sold and the easements were terminated, at that point <br />the conditional use permit for the marina would go away unless they can find a substitute parking area. <br />The marina is required to provide X number of parking stalls. <br /> <br />VOTE: Ayes 5, Nays 0. <br /> <br /> <br />PUBLIC HEARING <br /> <br />7. AMEND CHAPTER 31 REGARDING MASSAGE THERAPY LICENSING - <br />ORDINANCE NO. 87, THIRD SERIES <br /> <br />Curtis stated at the March 14th City Council meeting, the Council discussed Staff’s recommendation to <br />expand the required background checks for massage therapy centers to all massage therapists. The <br />current code requires that only the licensee must submit to a background check. Specifically crimes of <br />moral turpitude would be the subject of the City’s concern. <br /> <br />Staff has drafted amendments to the current licensing provisions to include background checks on all <br />persons performing massage at the licensed massage therapy center. <br /> <br />Staff recommends the Council adopt the amendment to Chapter 31 to require each individual massage <br />therapist to submit to a criminal background check as part of the massage therapy license. This criminal <br />background check would be covered by the original license fee and the background check conducted on <br />the licensee. No additional fees would be required for additional therapists under the license. <br /> <br />McMillan asked if the fee schedule would be $500. <br /> <br />Curtis indicated the fee for this type of background check is not as comprehensive as a liquor license <br />background check. The liquor license fee is $500 and the City fee for background checks for massage <br />therapy centers would be $150 for the original license, which would cover all of the massage therapists at <br />the center, and a $100 fee at the time of the annual renewal. <br /> <br />Item #03 - CC Agenda - 04/25/2011 <br />Approval of Council Minutes 04/11/2011 <br />[Page 12 of 30]
