153661v1 26 <br />3. the guest apartment does not have a separate address; <br /> <br />4. the guest apartment’s utilities are not metered separately from the <br />principal dwelling; and <br /> <br />5. the guest apartment is for the sole use of the occupants of the <br />principal dwelling, including their domestic employees and <br />nonpaying guests. <br /> <br />(3) Places of worship, provided that all buildings and structures, except columbaria, <br />are located at least 50 feet from any adjacent property zoned for residential use. <br /> <br />(9)(4) Planned Residential Development, limited to detached single-family dwellings <br />only and subject to the limitations of division 10 of this article. <br /> <br />(5) Public service structures, provided that: <br /> <br />a. all buildings are located at least 50 feet from any adjacent property zoned <br />for residential use; and <br /> <br />b. the architectural design of the structure is compatible with the architectural <br />design of the surrounding area. <br /> <br />(10) Duplex credit. One duplex may be located as a conditional use upon application, <br />provided that public sanitary sewer service is available and the lot is adjacent to a <br />commercial or industrial district, or within 250 feet of the B-3 district, and the <br />duplex is constructed within 200 feet of the commercial or industrial district. <br /> <br />(11) Apiaries. <br /> <br />(12) Farms (crop and stock) provided the area is ten or more acres. <br /> <br />(13) The keeping of domestic animals for noncommercial purposes, including horses <br />for the use of the occupants of the premises. A minimum of one acre in aggregate, <br />exclusive of one acre for the principal building, must be available for each animal <br />unit, except as set forth in this subsection. A minimum of two acres of open <br />pasture must be available for a single horse, and one additional acre must be <br />available for each additional horse. When the horses are kept stabled and do not <br />require pasture for feed purposes, the minimum pasture requirement may be <br />adjusted at the discretion of the council. Such minimum pasture acreage shall not <br />include wetlands as defined in section 78-1602. Any person keeping such animals <br />must comply with the provisions of this Code. <br /> <br />(14) Stables and barns, private. The use of an accessory building for keeping animals <br />for noncommercial purposes, provided it is for the noncommercial use of the <br />property owner or resident and meets the available area standards outlined in <br />Item #05 - CC Agenda - 11/22/2010 <br />File #10-3454 [Total Pages 151]
