153661v1 17 <br />b. the architectural design of the structure is compatible with the architectural <br />design of the surrounding area. <br /> <br />(10) Duplex credit. One duplex may be located as a conditional use upon application, <br />provided that public sanitary sewer service is available and the lot is adjacent to a <br />commercial or industrial district, or within 250 feet of the B-3 district, and the <br />duplex is constructed within 200 feet of the commercial or industrial district. <br /> <br />(11) Apiaries. <br /> <br />(12) Farms (crop and stock) provided the area is ten or more acres. <br /> <br />(13) The keeping of domestic animals for noncommercial purposes, including horses <br />for the use of the occupants of the premises. A minimum of one acre in aggregate, <br />exclusive of one acre for the principal building, must be available for each animal <br />unit, except as set forth in this subsection. A minimum of two acres of open <br />pasture must be available for a single horse, and one additional acre must be <br />available for each additional horse. When the horses are kept stabled and do not <br />require pasture for feed purposes, the minimum pasture requirement may be <br />adjusted at the discretion of the council. Such minimum pasture acreage shall not <br />include wetlands as defined in section 78-1602. Any person keeping such animals <br />must comply with the provisions of this Code. <br /> <br />(14) Stables and barns, private. The use of an accessory building for keeping animals <br />for noncommercial purposes, provided it is for the noncommercial use of the <br />property owner or resident and meets the available area standards outlined in <br />subsection (13) of this section. Further, no such structure shall be located less than <br />150 feet from the nearest adjacent residence and no closer than 75 feet from the <br />nearest lot line. <br /> <br />(15) Stables and barns, public. The use of accessory buildings or land for the storage or <br />rearing of animals not owned by the property owner or resident. Such use must <br />meet the requirements of section 78-74. Further, no such structure shall be located <br />less than 150 feet from the nearest lot line. <br /> <br />(16) Riding academy. Any such instruction maintained as an accessory use and <br />conducted by the owner shall meet the requirements of subsections (13), (14) and <br />(15) of this section; and no such instruction shall occur less than 100 feet from an <br />adjacent residence or less than 75 feet from the nearest lot line. <br /> <br />(17)(6) The pProvision of a bathtub or shower in an accessory building. Approval shall be <br />conditioned on provision of municipal sanitary sewer or a conforming sewage <br />treatment system designed to handle the anticipated flows from the building <br />plumbing.
