Draft Council Minutes of 10/11/10 <br />Application Summary: <br />At the October 11th meeting the Council reviewed the proposed ordinance allowing columbaria within <br />Orono. Additional testimony was heard from members of the public, specifically Good Shepherd <br />Church. <br />According to City Code section 78-43(a) a two thirds vote is required to amend the zoning code. <br />Councilmember Bremer stated as she was a member of Good Shepherd Church she would abstain <br />from the vote; and Councilmember McMillian was absent. Therefore the Council voted 3-0 to table <br />while directing staff to revise the ordinance language to better accommodate existing places of <br />worship within Orono. <br />Based on this direction, Staff is presenting Council with two options which address the setback of a <br />columbarium. Option 9 suggests a five-foot setback from all property lines, and does not have a <br />distinction based on the adjacent property's zoning classification. Option 2 proposes a 10 -foot <br />setback from residentially zoned property; a 5 -foot setback from non -residentially zoned property; and <br />a 5 -foot setback from City -owned parks, The other components — minimum 50 -foot setback from <br />adjacent principal structures and year-round screening — remain the same with both options. <br />Planning Staff Recommendation <br />The Council should indicate which option best addresses their previous concerns and approve or <br />amend the one of the draft ordinances. <br />COUNCIL ACTION REQUESTED <br />Adopt or amend one of the attached ordinances. <br />
