MINUTES OF THE <br />ORONO CITY COUNCIL MEETING <br />Monday, January 11, 2010 <br />7:00 o’clock p.m. <br />_____________________________________________________________________________________ <br /> Page 9 <br /> <br />(4. #09-3433 RICHARD HANSON, 340 BIG ISLAND – VARIANCE AND VACATION – <br />RESOLUTION NOS. 5899 & 5900, Continued) <br /> <br />McMillan stated she understands the seriousness of vacating property. McMillan noted the City in the <br />past has vacated other land for public good, such as a portion of Bracketts Point Road in order to obtain a <br />better turn-around. As it relates to this application, there is some public good being done with the <br />vacation in that it would put an end to a public nuisance and help stop trespassing in this area. McMillan <br />indicated she is in favor of vacating that portion of Meta Comet Avenue. <br /> <br />McMillan moved to adopt the Resolution Vacating a Portion of Meta-Comet Avenue Within the <br />Plat of Morse Island Park, with the following amendments: 1. Eliminate the whereas language <br />stating that Hanson is the owner of all property abutting the right-of-way proposed to be vacated <br />and replace it with the language that the portion of land to be vacated has never provided direct <br />lake access dead-ending approximately 40 feet from the lakeshore; and No. 2, the following <br />language be added: “This portion of the road was used to connect with Massasoit Avenue. <br />Massasoit Avenue was vacated in 2002 pursuant to Resolution No. 47-96. This disconnected <br />portion of Meta Comet Road has the potential to create ongoing trespassing on the private land <br />between the lake and the right-of-way proposed to be vacated.” <br /> <br />City Attorney Mattick stated he does not have any issues with the two suggestions by Council Member <br />McMillan. <br /> <br />Lambert pointed out there is a typo in Paragraph 4. <br /> <br />Bremer stated she would like to retain Item No. 1 in order to identify who Mr. Hanson is. <br /> <br />McMillan moved, Bremer seconded, to adopt RESOLUTION NO. 5900, a Resolution Vacating a <br />Portion of Meta-Comet Avenue Within the Plat of Morse Island Park, with the following language <br />being added under Item No. 2 on Page 1, “That the portion of land to be vacated has never <br />provided direct lake access, dead-ending approximately 40 feet from the lakeshore. This portion of <br />the road was used to connect with Massasoit Avenue. Massasoit Avenue was vacated in 2002 <br />pursuant to Resolution No. 47-96. This disconnected portion of Meta Comet Road has the potential <br />to create ongoing trespassing on the private land between the lake and the right-of-way proposed to <br />be vacated.” VOTE: Ayes 5, Nays 0. <br /> <br /> <br />*5. #09-3437 KENT AND SUSAN RICHEY, 3105 CASCO POINT ROAD – VARIANCE – <br />RESOLUTION NO. 5901 <br /> <br />Murphy moved, Bremer seconded, to adopt RESOLUTION NO. 5901, a Resolution Granting <br />Variances to Municipal Zoning Code Section 78-350 (B), for the property located at 3105 Casco <br />Point Road.
