ORONO PLANNING COMMISSION MEETING <br /> MINUTES FOR JANUARY 19, 2000 <br /> (Recess taken from 9:20 p.m. -9:28 p.m.) <br /> PUBLIC HEARINGS, CONTINUED <br /> (#1) #2540 BRADLEY HOYT, 2523 KELLY AVENUE,AFTER-THE-FACT CONDITIONAL USE <br /> PERMITNARIANCE, 9:28 p.m. -9:31 p.m. <br /> The Certificate of Mailing and Affidavit of Publication were noted. <br /> The Applicant was not present. <br /> Hawn inquired whether the Applicant had submitted any additional information on this <br /> application. <br /> Weinberger stated he has had very little contact with the Applicant, with no additional information <br /> having been submitted. <br /> Hawn noted this application has been called on two separate occasions, with no appearance <br /> by the Applicant or a representative on his behalf. Hawn stated this application cannot be <br /> approved without the additional information being submitted. <br /> Hawn inquired whether the 60 day review period needs to be extended. <br /> • Tom Barrett, City Attorney, stated the City does have the right to extend the 60 day review <br /> period under State Statutes without the Applicant's consent. <br /> Hawn suggested this application be extended to allow the Applicant time to submit the <br /> additional information. <br /> Hawn moved, Kluth seconded,to continue the denial of Application #2540, Bradley Hoyt, <br /> 2523 Kelly Avenue, After-the-Fact Conditional Use PermitNariance, and to return this <br /> matter back to the City Council for their review. <br /> Barrett noted the Applicant has received two letters from the City outlining the requirements <br /> of the City relating to the variances. Barrett stated without the additional information being <br /> submitted by the Applicant, a hardship has not been demonstrated and the application can be <br /> denied. <br /> VOTE ON THE ABOVE MOTION: Ayes 5, Nays 0. <br /> CONTINUED PUBLIC HEARINGS <br /> (#5)#2543 TED AND JUDITH EDIN, 3025 CASCO POINT ROAD -VARIANCES, 9:32 p.m. - <br /> 10:06 p.m. <br /> Ted Edin, Applicant, was present. <br /> Weinberger stated this application was tabled at the November Planning Commission meeting <br /> • to allow the Applicant time to revise his plan in an effort to reduce hardcover. <br /> Page 18 <br />
