.,. <br /> _ . <br /> _ � �� �; Cit� of ORONO <br /> � <br /> RESOLUTION OF THE CITY COUNCIL <br /> � NO. 2555 <br /> s - • • � <br /> A RESOLIITION GRANTING <br /> VARIANCES TO <br /> MIINICIPAL ZONING COD$ <br /> SECTION 10.03, SIIBDIVISION 9 (D) , <br /> AND SSCTION 10.03, SIIBDIVISION 15 (F) <br /> FILE NO. 1337 <br /> WH$REAS, Robert Paige (hereinafter "the applicant") is owner of <br /> the property located at 3493 Crystal Place within the City of Orono <br /> (hereinafter "City" ) and legally described as follows: <br /> Lots 9 and 10, Block 2, Navarre Heights, Henne�in County, Minnesota <br /> (hereinafter "the property" ) ; and <br /> WHEREAS, the applicant has applied to the City for a variance to <br /> Municipal Zoning Code Section 10.03, Subdivision 9 (D) to permit the <br /> construction of a detached garage located nearer the front lot line than <br /> the principal building, and a variance to Section 10.03, Subdivision 15 (F) <br /> to al low the garage to be constructed 5' from the side lot line where a 10' <br /> side setback is normally required. <br /> NOW, THBREFORE, BE IT RBSOLVED by the City Council of Orono, <br /> Minnesota: <br /> FINDINGS <br /> 1. This application was reviewed as Zoning.File #1337. <br /> 2. The property is located in the LR-1C Single Family Lakeshore <br /> Residential Zoning District. • <br /> 3. The Orono Planning Commission reviewed this application on <br /> November 21, 1988, and recommended approval of the requested variances <br /> based upon the following findings: <br /> A) The proposed garage will replace an existing garage which is <br /> located 3.3' from the side lot line, hence a greater setback than <br /> now exists will be obtained. <br /> B) The side setback variance is justified based on the location <br /> of the existing driveway and app licant's desire to not move that <br /> driveway and disrupt additional lawn area. <br /> C) Placement of the garage behind the extended west line of the <br /> house in order to avoid a variance would necessitate the removal <br /> of a number of mature trees and would eliminate the current rear <br /> yard area enjoyed by applicant. <br /> Page 1 of 4 • � <br />
