� O� <br /> � O O <br /> ' �� CITY of ORONO <br /> ��. <br /> � � <br /> �� ���` G'�' RESOLUTION OF T C T ,COUNCI L <br /> L�kESYiOg'� N O. �� � � <br /> CONCLUSIONS, ORDER AND CONDITIONS <br /> Based upon the above findings, the Orono City Council hereby grants variances to Orono <br /> Municipal Zoning Code Sections 78-1288 and 78-350 to allow consturction of a detached 20 <br /> foot by 24 foot garage, subject to the following conditions: <br /> 1. Council approval is based on the site and garage plans submitted by the Owner <br /> and annotated by City staff, attached to this Resolution as Exhibits A. and B. <br /> Any amendments to these plans may require further Planning Conunission and <br /> City Council review. <br /> 2. This approval does not grant the Owner the right to maintain a driveway within <br /> the adjacent street right of way to the west of the property. That will be done <br /> by a separate Encroachment Agreement. <br /> 3. Hardcover in the 0-75' zone shall be limited to 92 s.f. or 1.97%. Hardcover in <br /> the 75-250' zone shall be limited to 4,075 s.f. or 32.70%. The Owner shall <br /> also be allowed 485 s.f. of driveway hardcover within the 0-75' zone of the <br /> adjacent street right of way and 480 square feet of driveway hardcover in the <br /> 75-250' zone of the adjacent street right of way. If the driveway is relocated to <br /> the Owner's property this amount of hardcover will be allowed on the Owner's <br /> property. The hardcover allowance summary is depicted on Exhibit C. The <br /> owner is advised that any future requests to increase hardcover or change the <br /> nature of existing/approved hardcover shall require City approval, and <br /> increases in hardcover will not likely be approved without concurrent <br /> reduction in existing hardcover. <br /> 4. Owner shall not place any plastic or fabric liner material under any landscaping <br /> on the property to ensure their permeability as non-hardcover surfaces. <br /> 5. Authorities granted by this resolution run with the property not with the owner, <br /> but are permissive only and must be exercised by obtaining a building permit <br /> for the new consti-uction Uefore April 23, 2008 or the variances will expire on <br /> that date. <br /> 6. Violation of or non-compliance with any of the ternzs and conditions of this <br /> resolution shall constitute a violation of the zoning code, shall automatically <br /> Page 3 of 5 <br />
