I would refer you to the following
attactiecl dvcuments:
• Original 1908 plat of "Wallace's Addition to the Village of Minnetonka Beach".
The subject Lot 12 extends from the railroad right-of-way to the shoreline. Note
that ttiis olci plat acknowledges the existence of the "old traveled County Road"
but does not plat it as such.
The current County plat maps acknowledge the center line of Crystal Bay Road
as shown on an aerial photo, but again, that road has never been platted.
+ Ttie legal description in your deed includes all of Lot 12.
• The attached survey by Mark S. Gronberg dated 9/3/8b iudicates the actual
location of the traveled road within your property boundary.
Crystal Bay Road has existed for many decades as a public road serving properties in Wallace's
Addition between the railroad and the lake. By virtue of having maintained that road for many
decades and in fact placing sewer and water utilities in that read, the City apparently has what
amounts to a prescriptive easement over the traveled portion of the road, the utilities, and
perhaps over any part of the shoulder used for maintenance such as snow plowing. That
easement does not transfer ownership to the City, but merely allows the City to continue its
historic use of that portion of your property.
Telephone (612) 473-7357 • FAX 473-0510
