� — . <br /> � O ' V <br /> O � O <br /> ��d - C ITY of ORONO <br /> � � <br /> 'y' RESOLUTION OF THE CITY COUNCIL <br /> �L�kESH�g'�G N0. 3 � �$ `7' .w <br /> -�- <br /> A RESOLUTION GRANTING <br /> VARIANCES TO MUNICIPAL ZONING CODE <br /> SECTION 10.22, SUBDIVISIONS 1 (B) AND 2 <br /> FILE #2207 <br /> WHEREAS, Jonathan and Theresa Hofer(hereinafter "the applicants") are owners of the <br /> property located at 3339 Crystal Bay Road within the City of Orono (hereinafter "City") and legally <br /> described as follows: <br /> Lot 8, Wallace's Addition to the Village of Minnetonka Beach, Hennepin County, <br /> Minnesota <br /> WHEREAS,the applicants have applied to the City for variances to Municipal Zoning Code <br /> Section 10.22, Subdivision 1 (B)to pertnit construction of a 19'6" x 18' second floor addition above <br /> an existing garage to the lakeside of the existin�residence to be located 45' from the shoreline where <br /> a 75' setback is required, said structure shall be located 15' in front of the average lakeshore setback <br /> line where no such encroachment is allowed. Per Section 10.22, Subdivision 2 hardcover�vithin the <br /> 0'-75' setback area is existing and proposed at 2,0�0 sq. ft. or 43.37%. In the 75' -250' setback area <br /> hardcover is existing and proposed at 811 sq. ft. or 47.67% where 25% or 425.25 is allowed. <br /> NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, Minnesota: <br /> FINDINGS <br /> 1. This application was reviewed as Zoning File#2207. <br /> 2. The property is located in the LR-1C, Single Family Lakeshore Residential Zoning <br /> , District requiring 1/2 acre in area. The property consists of total area of 6,500 sq. ft. <br /> 3. The Orono Planning Commission reviewed this application on February 18, 1997, and <br /> recommended approval of the proposed variances based upon the following findings: <br /> A. A substantial portion (72.11%) of the subject property is located on the lakeside <br /> of the 75'shoreline setback. <br /> Page 1 of 5 <br />
