The proposed grading on this lot is minimal <br /> and as a result will have minimal if any environmental impacts but will <br /> alleviate an existing drainage issue for the Applicants' property. <br /> j. Applicants' initial plan to relocate onto the property the small 5'x9' shed that <br /> is partially in the HCRRA right-of-wa_y may be difficult to accomplish in a <br /> conforming manner. Therefore Planning Commission recommends that based <br /> on the small size of the proposed attached garage, it would be reasonable to <br /> provide the Applicants the option of eliminating the shed entirely and <br /> increasing the width of the garage by the square footage of the shed, as long as <br /> the required side setbacks can be maintained. <br /> k. Planning Commission finds that the property owner proposes to use the <br /> property in a reasonable manner, i.e. for residential purposes, in a manner <br /> similar to other homes on the block, on a parcel similar in size to a nurnber of <br /> others in the immediate neighborhood. The small lot was created and <br /> developed for residential use long ago, a circumstance not created by the <br /> owner. The proposed new residence will result in a home that is similar in <br /> scope to other homes in the immediate neighborhood on small lots with <br /> substandard setbacks and will not alter the character of the locality <br /> l. The Applicants' request is in harmony with the purpose and intent of the <br /> ordinance. <br /> m. The Applicants have demonstrated that enforcing the provisions of the Zoning <br /> Ordinance deprives the Applicants of the reasonable use of their Property. <br /> 4. The Applicants have submitted a revised proposal that eliminates the shed and <br /> adds approximately 49 square feet to the garage area by widening it by 2 feet <br /> while maintaining the required side setbacks. <br /> �. The City Council has considered this application including the findings and <br /> recommendation of the Planning Commission, reports by City staff, comments by <br /> the Applicants and the public, and the effect of the proposed variances and CUP <br /> on the health, safety and welfare of the community. <br /> 6. The City Council finds that the conditions existing on this Property are peculiar to <br /> it and do not apply generally to other property in this zoning district; that granting <br /> the variance wou]d not adversely affect traffic conditions, light, air nor pose a fire <br /> Page 5 of 8 <br />
