Box G6 <br /> Crystal Bay, MN ss3z3-oo�� FEg � � �gg� <br /> i��!Y OF O�;CNO <br /> February 17, 1997 <br /> I am writing in response to the letter you sent me dated February 6, 1997, regarding Municipal <br /> Code Section 10.60 Subdivision 8, which states lighting should not be detectable at the lot line. I <br /> have received your letter, but feel I must comment on the procedures that have/have not been <br /> followed in this situation. <br /> I feel that your enforcement of this code has been one sided thus far. The neighbors on either <br /> side of my property are appro�cimately 7+ feet from my lot line, and if and when they turn their <br /> outdoor light on the garage to the west, and their back door light to the east, it can't help but shine <br /> on my property and beyond my lot line. If a complaint was filed about their lights shining on my <br /> property and yard, they would no longer be able to turn their lights on at all and still be in <br /> compliance with this particular code. <br /> I have sent a copy of this letter to the Mayor and City Council. Therefore if this code is correct and <br /> enforceable please notify my neighbors that they will no longer be able to use the lights next to <br /> my lot and will have to remove them. <br /> I had contacted your office in October, 1996 and reported that NSP had turned the light and <br /> lowered it. You did not make any effort to contact me prior to writing your letter of complaint, nor <br /> did you contact NSP, so your decision was made without all of the necessary information. You were <br /> not aware of the measures I had already taken to accommodate the neighbors in this regard. <br /> Besides the changes NSP made, the addition of the fence screened direct light, and I had begun to <br /> plant G to 7' arborvitae trees on the fence line to provide year around screening, and will <br /> continue planting this spring. <br /> Before any further action is taken, I would ask that you come and see the lights at night, so you <br /> can get a better perspective on both sides of this argument. My intent was not to light the <br /> neighbor's yards, but to provide a safe environment around my home and property. <br /> Thank you for your time and consideration on this matter.
