. .� o�. <br /> 0 0 <br /> � �� CITY of ORONO <br /> 3 <br /> � '", _�;�,. �'/ <br /> �''� �� G�' RESOLUTION OF THE CITY COUNCIL <br /> t�kESH�4� NO. 5 � � � <br /> CONCLUSIONS, ORDER AND CONDITIONS <br /> Based upon the above findings, the Orono City Council hereby b ants variances to Orono <br /> Municipal Zoning Code Section 78-1279 to allow an entry addition forward of the average <br /> lakesl�ore setback and to Orono Municipal Zoning Code Section 78-1403 to allow 1691 <br /> percent structural coverage and approves a revision to the setback variance approved by <br /> Resolution No. 3327 to allow a box bay, subject to the following conditions: <br /> l. Council approval is based on the site and house plans submitted by the Owners <br /> and annotated by City staff, attached to this Resolution as Exhibits B and C. <br /> Any amendments to these plans may require further Planning Commission and <br /> City Council review. <br /> 2. The box bay shall be at least 8 feet from the side property line. <br /> 3. Owners shall not place any plastic or fabric liner material under any <br /> landscaping on the property to ensure their permeability as non-hardcover <br /> surfaces. <br /> 4. Authorities granted by this resolution run with the Property not with the <br /> owners, but are permissive only and must be exercised by obtaining a building <br /> permit for the entry and box bay before March 10, 2009 or the variances will <br /> expire on that date. <br /> 5. Violation of or non-compliance with any of the terms and conditions of this <br /> resolution shall constitute a violation of the zoning code, shall automatically <br /> terminate any authority granted herein, and shall be punishable as a <br /> misdemeanor. <br /> The Orono City Council hereby clarifies and corrects Resolution Nos. 2642 and 3327 as <br /> follows: <br /> Hardcover in the 0-75' zone shall be limited to 764 s.f. or 22.56%. Hardcover in the 75- <br /> 250' zone shall be limited to 2,488 s.f. or 32.88% per the hardcover allowance summary <br /> as depicted on Exhibit D. Required hardcover removals to reach these levels shall occur <br /> Page 3 of 5 <br />
