Prueter and Jennifer A. Prueter, husband and wife, <br /> (hereinafter "Owners") are the owners of the property located at 3215 Crystal Bay Road <br /> within the City of Orono (hereinafter "City") and legally described as: See Exhibit A <br /> (hereinafter "the Property"); and <br /> WHEREAS, Owners have made application to the City for a variance to <br /> Municipal Zoning Code Section 78-1279 to allow construction on the Property of an entry <br /> addition forward of the average lakeshore setback; and <br /> WHEREAS, Owners have made application to the City for a Variance to <br /> Municipal Zoning Code Section 78-1403 to allow structural coverage on the Property of <br /> 16.94 percent to construct an entry addition; and <br /> WHEREAS, Owners have made application to the City to revise the variance <br /> to Municipal Zoning Code Section 78-350 granted by Resolution No. 3327 to allow a box <br /> bay for a fireplace in the east wall of the house; and <br /> WHEREAS, after due published notice and mailed notice in accordance with <br /> Minnesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning <br /> Commission held a public hearing on January 22, 2008, at which times all persons desiring to <br /> be heard concerning this application were given the opportunity to speak thereon; and <br /> WHEREAS, in researching this application City Staff found that Resolution <br /> No. 2642 approved hardcover in the 0 to 75 foot zone for the Property but did not state the <br /> amount of hardcover; and <br /> WHEREAS, in researching this application City Staff found that the <br /> hardcover calculations included in Resolution No. 3327 contained errors. <br /> Page 1 of 5 <br />
