Eddington and Mark R. Larson <br /> (hereinafter "the applicants") filed a petition with the City of Orono requestin� the vacation of <br /> a portion of an unimproved public right-of-way originally dedicated in the plat of Bayside <br /> Addition to Lake Minnetonka, Hennepin County, Minnesota lying between Lot 8 Block 2 and <br /> Lot 1 Block � thereof, and legally described as follows: <br /> That part of Hill Street w•hich lies between the northerly extensions of the east <br /> and w-est lines of Lot l, Block S, "Bayside Addition to Lake Minnetonka", <br /> Hennepin County, Minnesota; and <br /> WHEREAS, after due published and posted notice, a public hearing was held <br /> by the City's Planning Commission on October 15, 2001 regarding said vacation and all <br /> interested persons �vere given an opportunity to be heard; and <br /> `VHEREAS, after due standing and consideration, the Planning Commission <br /> recommended unanimous approval of the proposed vacation; and <br /> WHEREAS, the City Council of the City of Orono finds that said vacation as <br /> proposed is in keeping with the public interest and in consideration of the follo�ving findinas; <br /> l. The unimproved right-of-�vay contains no municipal sewer or other utilities. <br /> 2. The 40 foot right-of-���ay has never been developed as a public street. <br /> 3.
