Sec.13.Od R/GHTSOFSUBJECTSOFDATA � . <br /> Subdrvision 1. Type of data. The rrghts of rndividua!on whem the data is slored or ta be stored shall be as set forth rn thrs section. <br /> Subd.2. Injormation required to be given individuaL An indivrdua!asked to supply prrvate or confidential data concerning himself <br /> shall be informed of. (a)1he p:�rpose and intended use ojthe requested data wilhin the collecting state agency,politica!subdivision,or statewide <br /> system;(b)whether he may refuse or is legally required to supply the reguested data;(c)any knoivn consequence arrsing from his supplying or <br /> refusing to supply prrvate ar confidentral data,and(d)the rdentiry of other persons or entities authorrzed by state or federal law to receive the data. <br /> This requiremenl shall not appfy ivhen an rndividual is asked to supply rnvestigative data,pursuant to sectron 13.82, subdivrsion 5, to a lativ <br /> enforcement o�cer. <br /> The commrssioner of revenue mcrv place the notice required under thrs subdivrsion rn the rndividual income tax or property tax rejund <br /> inslruetrons instead of on those forms. <br /> Subd.3. Access to dala by individual. Upon request to a responsible authority,an individual shall be informed whether he is the subject <br /> ojstored data on individuals, and whether it is classifred as public,prrvate or confidential. Upon his further request,an rndividual who is the <br /> subject oJstored prrvate or publrc data on rndividuals shall be shoivn the data witho:�t any charge to him and,if he desrres,shall be rnjormed of <br /> 1he conlent and meaning of that data. After an indrvidua!has been shotivn the private data and rnjormed of its meaning, the data need not be <br /> drsclosed to him for six months thereafter unless a dispute or action pursuant to this section rs pending or additional data on the rndividua!has <br /> been colleeted or created. The responsible authoriry shall provide copies of the private or p:�blrc data upon request by the indrvidual subject of <br /> the data. The responsrble at�thority may require the requestrng person to pay the actual costs of making,cert�ing,and compiling the copies. <br /> The responsi6le authorrry shall comply immediately,ifpossible,ivith any request made pursuant to this subdivision,or within frve days <br /> of the date oJthe reguest,excluding Saturdays,Sundays and legal holydays,if immedrate compliance is not possrble. If he cannot comply ivith the <br /> request�vithin that time,he shall so injorm the individual,and may have an additional five days lvrthrn which to comply with the request,excludrng <br /> Saturdays,Sundays and legal holidays. <br /> Subd.4. Procedure when data is not aeeurate ar eomplete.An indivrd:�a!may contest the accuracy or con:pleteness ofpub[ic or private <br /> data concernrng himself. To exercise thrs right, an individual shall not�in wrrting the responsible authority describing the nature of the <br /> disagreement. The responsible authorrty shall ivrthrn 30 days either: (a)correct the datafound to be inaccurate or incomplete and attempt to not� <br /> past recipients of inaccurate or incomplete data,rncluding recrpients named by the individual;or(b)not�the individua!that he believes the data <br /> to be correct.
