The Property is located in the LR-lA zoning district, where 2 acres is the <br /> minimum lot area and 200 feet is the minimum lot width. The Property is <br /> approximately 0.288 acre in area and 100 feet in width. <br /> 3. The Planning Commission reviewed this application on September 15, 2008 <br /> and on a vote of 6 - 0 recommended approval of the variances, based on the <br /> following findings: <br /> a. The property is 0.288 acres when the zoning district required 2.0 acres. <br /> b. The existing house is small witr. no basement and no second story. It <br /> cannot be expanded without variances. <br /> c. The proposed additions are modest. <br /> d. Given the location of the house, there is no location on the property where <br /> a detached garage could be constructed without a setback variance. <br /> e. The proposed garage will be 0.6 feet farther from the north property line <br /> than the existing garage and 12 farther from the west property line. <br /> f. The proposed garage will be more in character with the house and the <br /> neighborhood than the existing garage. <br /> 4. The City Council has considered this application including the findings and <br /> recommendation of the Planning Commission, reports by City staff, comments <br /> by the applicants and the public, and the effect of the proposed variance on the <br /> health, safety and welfare of the community. <br /> 5. The City Council finds that the conditions existing on this property are peculiar <br /> to it and do not apply generally to other property in this zoning district; that <br /> granting the variances would not adversely affect traffic conditions, light, air <br /> nor pose a fire hazard or other danger to neighboring property; would not <br /> merely serve as a convenience to the Owner but necessary to alleviate a <br /> demonstrable hardship or difficulty; is necessary to preserve a substantial <br /> property right of the Owner; and would be in keeping with the spirit and intent <br /> of the Zoning Code and Comprehensive Plan of the City. <br /> Page 2 of 4 <br />
