� o� <br /> 0 0 <br /> ' � � CITY of ORONO <br /> � �.�:�'� � <br /> RESOLUTION OF THE CITY COUNCIL <br /> ���'����44�G NO. � � O � <br /> Fin ncil Revisions of 7-12-04 <br /> A RESOLUTION APPROVING THE <br /> PRELIMINARY PLAT FOR PROPERTY LOCATED AT <br /> 120 BROWN ROAD SOUTH <br /> FILE NO. 04-3016 <br /> WHEREAS,Wayzata Design and Development LLC (hereinafter the "Developer") <br /> has an interest in the property witl�in the City of Orono (hereinafter the "City") located at 120 Brown <br /> Road South and legally described as follows: <br /> Tract H, Registered Land Survey No. 352, Hennepin County, Minnesota <br /> (hereinafter the "Property"); and <br /> WHEREAS, on April 21, 2004 the Developer filed a fonnal subdivision application <br /> with the City for preliminary approval of a seven lot residential plat of the Property in conjunction with <br /> a request far Orono Planned Residential Development (PRD) approval for development of the <br /> Property; and <br /> WHEREAS, after due published and mailed notice in accordance with Minnesota <br /> Statutes 462.358 et. seq. and the City of Orono Zoning and Subdivision Codes, the Orono Planning <br /> Commission held a public hearing on May 17, 2004, at which time all persons desiring to be heard <br /> concerning this application were given the opportunity to speak thereon; and <br /> WHEREAS, at its regular meetings of June 14 and June 28, 2004, the Orono City <br /> Council considered the subdivision application of the developer; and <br /> WHEREAS,the City Council hereby makes the following findings in regard to this <br /> application: <br /> FINDINGS <br /> 1. This application was reviewed as Zoning File #04-3016. <br /> 2. The property is zoned RR-1B Single Family Rural Residential District,which normally <br /> requires a minimum lot area of 2.0 acres and minimum lot width of 200' The <br /> Property is 20.0 acres in area, of which 6.0 acres is wetland and 14.0 acres is non- <br /> wetland area. <br /> Page 1 of 13 <br />
