Because your 35' X 65' court is <br /> more than 1000 square feet the Orono Zoning Code Sections 10.03, Subdivision 14 (C) and <br /> Subdivision 14 (D) require that it be located 30' from a side property line. Yours appears to be <br /> about 7' or 8'. <br /> If you or your contractor had applied for the required permit prior to beginning work you <br /> would have known about these requirements in advance. When your contractor started work <br /> even though there was no permit posted he left you in a difficult position <br /> You also hired a landscape contractor to build a fenced in garden. This garden does not <br /> require a permit, but it does need to be: <br /> 1. On your property <br /> 2. No more than 6' high within 30' of the property line <br /> 3. No fill or retaining wall may be within 5' of the property line <br /> Section 12.02 of the Orono Zoning Code says: "The owner and/or occupant of any <br /> property, upon which any work has been done in violation of any Building Code or zoning <br /> requirement shall be responsible for obtaining a permit, and/or for correcting, removing or <br /> abating such violation within thirty days after notice from the City that such violation exists." <br /> Therefore, if you and your contractors have not corrected these violations by July 21, <br /> 2003, the City may initiate legal action.
