. ` <br /> . , � • { � • <br /> Clt� o� ORONO � <br /> • RESOLUTION OF THE CITY COUNCIL <br /> � NO. 2290 <br /> � <br /> ' • - • • <br /> B) The increase in 75-250' hardcover on the property can be <br /> minimized to an increase of 4/10 of 1 percent ( 0.4�) by removal <br /> of a 168 s.f. block patio on the lake side of the house. <br /> 4. The hardcover can be further reduced by removal of 277 s.f. of <br /> patio blocks adjacent to the proposed deck. <br /> 5. The wood play structure located near the 168 s.f. patio will not <br /> encroach on any lake views enjoyed by neighbors. <br /> 6. The City Council has considered this application including the <br /> findings and recommendations of the Planning Commission, reports by <br /> City staff, comments by the applicant and the effect of the proposed <br /> variance on the health, safety and welfare of the community. <br /> 7. The City Council finds that the conditions existing on this <br /> property are peculiar to it and do not apply � generally to other <br /> • property in this zoning district; that granting the variance would not <br /> adversely affect traffic conditions, light, air nor pose a fire hazard <br /> or other danger to neighboring property; would not merely serve as a <br /> convenience to the applicant, but is necessary to alleviate a demon- <br /> strable hardship or difficulty; �is necessary to preserve a substantial <br /> property right of the applicant; and would be in keeping with the <br /> spirit and intent of the Zoning Code and Comprehensive Plan of the <br /> City. <br /> CONCI�IISIOI�S, ORDER AP1D CONDITIONS <br /> Based upon one or more of the findings noted above, the Orono <br /> City Council hereby grants a variance per Municipal Zoning Code Section <br /> 10.22, Subdivision 1 & 2 to permit the construction of a second story deck <br /> which encroaches l2' into the average lakeshore setback zone where no <br /> sncroachment is normally allowed, and which results in a net decrease in <br /> hardcover in the 75-250' lakeshore setback zone from 45.3$ existing to <br /> 44.6$ where only 25� hardcover is normally allowed, subject to the <br /> following conditions: . <br /> l. Applicant shall remove 168 s.f. of hardcover contained within the <br /> block patio located at the southerly corner of the house (see Exhibit <br /> A attached). Applicant shall also remove 277 s.f. of patio blocks <br /> adjacent to and not under the proposed deck. The 110 s.f. play <br /> structure is allowed to remain. Final hardcover on the property is <br /> • allowed as fo7.lows and per the hardcover worksheet attached as Exhibit <br /> B: <br /> 0-75 ° Zone = 9� <br /> 75-250' Zone = 44. 6g <br /> 250-500 ' Zone = 30$ <br /> Page 2 of 4 <br />
