The City can confirm that applicant has made every <br /> attempt to acquire additional lands in order to construct <br /> the much needed garage and storage area. <br /> f. The City has received only positive comments from the <br /> affected neighbors. <br /> 4. The City Council has considered this application including <br /> the findings and recommendations of the Planning Commission, <br /> reports by City staff, comments by the applicant and the effect <br /> � of the proposed variances on the health, safety and welfare of <br /> the community. <br /> 5. The City Council finds that the conditions existing on this <br /> property are peculiar to it and do not apply generally to other <br /> property in this zoning district; that granting the variance � <br /> would not adversely affect traffic conditions, light, air nor <br /> pose a fire hazard or other danger to neighboring property; would <br /> • not merely serve as a convenience to the applicant, but is <br /> necessary to alleviate a demonstrable hardship or difficulty; is <br /> necessary to preserve a substantial property right of the <br /> applicant; and would be in keeping with the spirit and intent of <br /> the Zoning Code and Comprehensive Plan of the City. <br /> CONCI,IISIONS, ORDER AND CONDITIONS <br /> Based upon one or more of the findings noted abov�, The <br /> Orono City Council hereby grants variances to Municipal Zoning Code <br /> Sections 10.03, Subdivision 15 (F) and 10.22, Subdivision 2 to �he <br /> permit the construction of a detached garage placed 3 feet from the <br /> side Iot line instead of the required 10 feet and additional <br /> improvements on the property requiring approval of additional <br /> accessory hardcover for a detached garage (576 s.f.) and an expansion <br /> of the paved area for driveway purposes at 294 s.f. resulting in a <br /> total hardcover amount of 2,131 s.f. within the 75-250' setback area <br /> at 37.7 � where only 25g is aliowed, subject to the following <br /> conditions: , <br /> l. The existing shed in the street yard shall be removed prior to <br />' the issuance of a building permit for new construction. <br /> 2. Authorities granted by this resolution run with the property <br /> not with the applicant, but are permissive onYy and must be <br /> exercised by application for a building permit within one year of <br /> • the date of Counci 1 approva I, or this variance wi 1 I expire on� <br /> that date (October 12, 1988). <br /> � Page 2 of 4 <br />
