Huber (hereinafter "the applicant") is the <br /> owner of the property located at 2615 Shadywood Road within the City of <br /> Orono (hereinafter "City") and legally described as follows: <br /> See Legal Attached as Exhibit A <br /> WHEREAS, the applicant has applied to the City for a variance to <br /> Municipal Zoning Code Section 10.03, Subdivision 9 (D) to permit the <br /> construction of a pool , gazebo and pump storage shed located within the <br /> front/street yard in front of the front line .of the principal residence. <br /> NOW, TH$ItEFORE, BE IT RSSOLVED by the City Council of Orono, <br /> Minnesota: . <br /> , <br /> FINDINGS <br /> • l. This application was reviewed as Zoning File #1193. <br /> 2. The property is located in the LR-1B Single Family Lakeshore <br /> Residential Zoning District. <br /> 3. The Orono Planning �Commission reviewed this application on <br /> September 21, 1987, and recommended approval of the proposed variance <br /> � based upon the following findings: <br /> A) The rear yard to the south of principal residence W�i1 on <br /> • occasion retain water within 60 feet of the house. <br /> B) The interior layout of the house would suggest that the <br /> Shadywood Road or front/street side of the house is designed to <br />. be the back or rear yard. <br /> C) Natural screening along the street lot line and the 20 feet <br /> higher elevations of the front yard provide a visual buffer for� <br /> proposed improvements. <br /> D ) The City has not received any negative comments from <br /> neighboring property owners regarding this application. <br /> 4. The City Council has considered this appYication including the <br /> ' • findings and recommendations of the Planning Commission, reports by <br /> City staff, comments by the applicant and the effect of the proposed <br /> variance on the health, safety and welfare of the community. <br /> Page 1 of 3 <br />
