(ly •+� <br /> ' S . <br /> � cit� o� oRONo <br /> � RESOLUTION OF THE CITY COUNCIL <br /> � NO. 2267 <br /> � <br /> ' • - • • . <br /> A R$SOLIITIOT� GRANTING ' <br /> AI�PROVA� OF THE PRELIMINARY <br /> . � PLAT OF A�IICHAEL PLANR <br /> APPLICATIOpii 2d0. 1194 <br /> WH�REAS, Michael Plank (hereinafter "the applicant") on August <br /> 14, 1987 filed a Class III subdivision application with the City of Orono <br /> (hereinafter "City") for approval of a three-lot plat of property legally <br /> described on Exhibit A attached to this resolution and hereinafter referred <br /> to as the property; and <br /> WHER$ASo after due published and mailed notice in accordance with <br /> Minnesota Statues 462.358 et. seq. and the City of Orono Zoning and <br /> Subdivision Codes, the Orono Planning Commission held a public hearing on <br /> September 8 , 1987 , at which time all pe�rsons desiring to be heard <br /> concerning this application were given the opportunity to speak thereon; <br /> and <br /> WH�RSAS, at their regular meeting held on September 28, 1987, the <br /> • Orono City Council considered the subdivisi:on application of Michael Plank, <br /> noting the following findings of fact: <br /> l. The property is located within the RR-lA Single Family Rural <br /> Residential zoning district requiring a minimum of 5 acres of <br /> cumulative dry buildable land with a minimum of 2 acres contiguous <br /> land. _ <br /> 2. The property consists of 24.9 acres. Lot 1 contains 5 acres of <br /> dry lands with 2.7 contiguous dry acres; Lot 2 contains 5 acres of dry <br /> lands; and Lot 3 contains 11.7 acres of dry lands. <br /> 3. Lot 1 shall achieve access via a future curb cut off Watertown <br /> Road; Lot 2 shall continue to use existing approved access and Lot 3 <br /> shal 1 be served by an approved driveway, recently constructed, at <br /> northeast edge of property. <br /> 4. The existing access within Lot 3 shall serve as a shared drive <br /> when Lot 3 is divided in the future. <br /> � 5. . A single family residence can be constructed on Lot 1 without the <br /> need for future variances: <br /> NOW, THER�FOR� BL IT R�SOLVED, that based upon either one or more <br /> of the findings noted above, the City Council of the City of Orono hereby <br /> • approves the preliminary plat of Michael Plank per plat drawing by Coffin <br /> and Gronberg, Inc. dated July 15, 1987 revised September 2, 1987 and <br /> further grants a variance to the standard that would require arl �iots have <br /> frontage on a public road with the creation of the clriveway outlot serving <br /> Lot 3, subject to the following conditions: <br /> Page 1 of 3 <br />
