The City Council finds "that granting a Conditional Use Permit to <br /> allow the earthen berm to remain will not be detrimental to the <br /> • health, safety or general welfare of the public, would not adversely <br /> affect light, air nor pose a fire hazard or other danger to <br /> neighboring properties, nor will it depreciate surrounding property <br /> values and that the proposed level of use of the property will be in <br /> keeping with the intent and objectives of the Zoning Code and <br /> � : Comprehensive Plan of the City. _ <br /> CO1dCLIISIONS, ORDER AIdD CONDITIONS • <br /> Based upon one or more of the above findings, the Orono City <br /> Council hereby grants a Conditional Use Permit per Municipal Zoning Code <br /> Section 10.03, Subdivision 19 to permit �he existing berm to remain in the <br /> rear yards. of 2220 and 2235 French Creek Circle, subject to the following <br /> conditions: <br /> l. � The berm shal l not exceed the present height of 5 feet 6 inches. <br /> • The east side of berm must be regraded and finished at a 4:1 grade <br /> slope. Ground is to be restored by October 31, 1987. <br /> 2. Applicants are hereby advised that any expansion or extension of <br /> this berm must be authorized under appropriate permitting by the City. <br /> Per Section 10.03, Subdivision 15 (E), applicants are further advised <br /> that a fence in excess of three and one half feet can not be installed <br /> within the berm area. <br /> 3. Violation of or non-compliance with any of the terms and condi- <br /> tions of this resolution shall constitute a violation of the zoning <br /> code, shall automatically terminate any authority granted herein, and <br /> shall, be punishable as a misdemeanor. <br /> 4. The undersigned applicants have read, understood and hereby agree <br /> to the terms of this resolution and on behalf of themselves, their <br /> heirs, successors and assigns, hereby agree to the recording of this <br /> resolution in the chain of title of the property. <br /> _ _ .
