Cit� o� ORONO <br /> • RESOLUTION OF THE CITY COUNCIL <br /> � NO. 219 8 <br /> � <br /> ' • - • • <br /> 6. The City Council finds that the conditions exi�ting on this <br /> property are peculiar to it and do not apply generally to other <br /> property in this zoning district; that granting the variance would not <br /> • adversely affect traffic conditions, light, air nor pose a fire hazard <br /> or other danger to neighboring property; would not merely serve as a <br /> convenience to the applicants, but is necessary to alleviate a demon- <br /> strable hardship or difficulty; is necessary to preserve a substantial <br /> property right of the applicants; and would be in keeping with the <br /> � �.s.pirit and intent of the Zoning Code and Comprehensive Plan of the <br /> City. <br /> CONCLDSIONS, ORDER AND CONDITIONS <br /> Based upon the above findings, the Orono City Council hereby <br /> � grants a variance per Municipal Zoning Code Section 10.03, Subdivision 15 <br /> , (C) to permit the construction of a fence 6' in height along a front <br /> property line where only a 3�Z' high fence is normally allowed: <br /> • l. The 6' fence shall be located at least 5' from the front property <br /> line at the west end, and no further than 12' from the house at the <br /> jog in the house, and there ending, and shall at no point be higher <br /> than 6' above existing grades. (See Exhibit A attached.) <br /> 2. Applicant shall execute a hold harmless agreement for any damage <br /> the City may cause to the fence during normal maintenance of the road <br /> and utilities. As long as the 6' fence exists, no additional fence <br /> may be constructed between it and the road right-of-way. <br /> 3. Authorities granted with this resolution run with the property not <br /> with the applicants, but are permissive only and must be exercised by <br /> application for a building permit within one year of the date of <br /> Council approval, or this variance will expire on that date (June 8, <br /> 1988 ) . <br /> 4 . Violation of or non-compliance with any of the terms and <br /> conditions of this resolution shall constitute a violation of the <br /> , zoning code, shall automatically terminate any authority granted <br /> herein, and shall be punishable as a misdemeanor. <br /> � � • •��5: The undersigned • appl�icants have �read, �understood and hereby agree <br /> to the terms of this resolution and on behalf of themselves, their <br /> heirs, successors and assigns, hereby agree to the recording of this <br /> resolution in the chain of title of the �property. <br /> • <br /> Page 2 of 4 <br />
