RESOLUTION OF THE CITY COUNCI L <br /> �� NO. 2190 <br /> �. <br /> ' • � • • A RESOLDTION ORDERII�G ABATEMENT <br /> OF HAZARDODS BIIILDING ACTION AT <br /> 3536 LYRIC AVENDE, ORONO <br /> WHEREAS, the City of Orono is a municipal corporation organized <br /> and existing under the laws of the State of Minnesota; and <br /> • WH$REAS, Richard Bowman Gilmore, Mary Ellen Anthony and Audry S. <br /> Gilmbre are the owners of record and Charles Lewis Henke has an interest in <br /> � the property located at 3536 Lyric Avenue, Orono, Minnesota, herein <br /> referred to as "the property", and legally described as follows: <br /> Lots 19 & 20, Block 4, "Navarre Heights", Hennepin County, Minnesota <br /> (P.I.D. 17-117-23 43 0056) ; and � <br /> WHER$1�5, the City Council of the City of Orono, having duly <br /> considered the matter pursuant to Minnesota Statutes Sections 463.15 to <br /> 463.261, hereby finds that the above described property is uninhabitable <br /> and contains unsanitary and hazardous conditions which constitute a public <br /> nuisance and which makes this property hazardous to the public health, <br /> � safety and welfare based on the following findings: <br /> 1. Over two layers of roofing materials on 2x4 rafters; <br /> 2. Improper footings - concrete blocks stacked without mortar in <br /> joints - improper depth. <br /> 3. Building is in a state of deterioration and dilapidation, thus it <br /> is a safety and health hazard pursuant to Minnesota State Building <br /> Code/Uniform Building Code, Section 203. <br /> 4. Orders to remove or repair the structure were issued by the <br /> Building Official on February 19, 1985 and September 10, 1986. These <br /> orders have not been complied with. <br /> NOW, THEREFOR�, BE IT R$SOLVED as follows: <br /> 1. That the City Council of the City of Orono, pursuant to State <br /> Statute 463.251, hereby orders the owner(s) to board-up and secure the <br /> structure within ten (10) days. The City Council further orders that <br /> unless corrective action is taken within ten (10) days from the date <br /> of service of this order, it wil 1 result in the City properly securing <br /> the bui lding and the cost thereof wi 11 be charged against the rea 1 ' <br /> estate as provided in State Statute Section 463.21. <br /> 2. The City Counci:l of the City of Orono, pursuant to the foregoing <br /> • findings and in accordance with Minnesota Statutes Sections 463.15 to <br /> 463.261 hereby orders the owner(s) of the property to make the <br /> fol lowing repairs in order to correct the hazardous condition: <br /> Page 1 of 2 _ _ <br />
