Review ofthe submitted survey/grading plan by Gronberg <br /> &Associates dated 8/13/02 indicates approximately 4 feet of fill is proposed above the base of the <br /> mature maple tree between the garage and the front entry. This fill will undoubtedly have a negative <br /> impact on the continued vitality of that tree,and would appear to be in direct conflict with Condition <br /> No. 3 of variance approval Resolution No. 4792, which reads as follows: <br /> "3. Applicants and their agents shall take all feasible and reasonable steps to ensure the <br /> continued viability of the 3 mature maple trees identified as contributing to the <br /> hardship situation on the property. If one or more of said trees dies or is removed <br /> within the first 5 years after redevelopment of the site commences,said trees shall be <br /> replaced immediately with the most substantial trees of like character that can feasibly <br /> be transplanted in the approximate same locations as the trees lost." <br /> Filling around the base of this tree as proposed would also appear to be in conflict with the <br /> recommendations of the Twidwell's forester, Steven J. Cook,per his letter of March 2, 2002 (copy <br /> attached). <br /> It is our conclusion that the proposed grading plan is unacceptable as presented, hence a building <br /> permit cannot be issued until this matter is resolved. In order for the City to issue the building <br /> permit, you must provide the following: <br /> 1. A revised grading plan. <br /> 2. A written plan and diagram indicating exactly how the three maples will be protected during <br /> the demolition/construction process. <br /> 3.
