� Sec.13A4 RlGHTSOFSUBJECTSOFDATA � . Subdivisron 1. Type of dat2 The rights of individual on whom the data is stored or to be stored shal!be as set forth in this section. Subd.2. Injormation required to be given individuaL An indrvidual asked to supply private or confrdentia!data concernrng himself shafl be informed of. (a)the purpose and intended use of the reguested data wrthin the collecting state agency,polrtical subdivision,or statewide system;(b)whether he may refuse or is legally requrred to supply the requested da�a;(c)any known consequence arlsing from his supplying or refusing to supply private or confrdential data;and(di the identity of other persons or entities authorized by state or federal law to receive the data. This requrrement shall not apply ivhen an individual is asked to supply investigative data,pursuant to sectron 13.82, subdivision 5, to a!mv enforcement o�cer. The commissioner orrevenue may place the notice required under this subdivision in the individual rncome tax or propertv tax refund instructions instead of on those jorms. Subd.3. Access to data by individuaL Upon request to a responsible authority,an indivrdua/shall be informed whether he is the subject oJstored data on individuals, and whether it is classifted as public,prrvate or confidential. Upon his further request,an individual who rs the subject o,jstored private or public data on individuals shall be shown the data without any charge to him and, if he desires,shall be informed of the content and meanrng of that data. Ajter an individual has been shotivn the private data and informed of its meaning, the data need not be drsclosed lo him jor six months thereajter unless a dispute or action pursuant to this sectron is pending or additional data on the individua!has been collected or created. The responsrble authoriry shall provide copies of rhe private or publrc data upon request by the rndivrdual subject of the dala. The responsible authorrty may require the requesling person to pay the actual costs of makrng,cert�ing,and compiling the copres. The responsible authorrry shall camply immediately,ifpossible,with any request made pursuant to thrs subdivisron,or within five days of the date of the request,excluding Saturdays,Sundays and lega!holidays,if immediate compliance is not possible. !f he cannot comply with the reques!within that time,he shal!so injorm the rndividua/,and may have an additronal five days lvithrn which to comply ivith the request,excluding Saturdays,Sundays and legal holidays. Subd.4. Procedure when data is not accurate or complete.An individual may contesl the accuracy or completeness oJpublrc or private data concerning himself. To exercise this rrght, an individua!shall notrfy in writing the responsible authority describing the nature of the drsagreement. The responsrble authority shal!wrthin 30 days erther: (a)correct the data found to be inaccurate or rncomplete and attempt lo not� past reciprents of inaccurate or incomplete data,rncluding recipients named by the indrvidual;or(b)notify the individual that he believes ihe data to be correct. Data rn dispute shal!be disclosed only if the indrvidual's statement af disagreement is rncluded with the disclosed data. The determinatron ofthe responsrble authority may be appealed pursuant to the provisions of the adminrstrative procedure act relating 10 contested cases.
