The project �vill not require variances for hardcover. The project <br /> includes removal of the existing 22' X 28' detached garage and part of <br /> the e�CistinQ driveway to reduce hardcover. <br /> B. The right of �vay that is located bet�veen 1825 Concordia Street and the <br /> adjacent lot w�as dedicated for public use in the plat of Coffee's Addition <br /> in 1906. There is no specific plan by the City to develop the right-of- <br /> way or use it for any public purpose other than drainage. <br /> C. The right of way is a lo�v area that collects water during heavy rainfall. <br /> D. The 8' setback has been requested to meet the minimum setback from tl�e <br /> property line and to not encroach closer than the existing corner of the house. <br /> The variance �vould not allo�v any further encroachment to the side setback to <br /> the right of way. <br /> E. The addition would not encroach closer than 23' to the adjacent residential <br /> property line due to the 8' setback and the 15' width of the ri�ht of way. A <br /> common property fine �vould only require 20' beriveen houses. <br /> 4. The City Council finds that the conditions existing on this property are peculiar <br /> to it and do not apply generally to other property in this zoning district; that <br /> granting the variances �vould not adversely affect traffic conditions, light, air nor <br /> pose a fire hazard or other danger to neighboring property; would not merely <br /> serve as a convenience to the applicants, but is necessary to alleviate a <br /> demonstrable hardship or difficulty; is necessary to preserve a substantial <br /> property right of the applicants; and would be in keepin� �vith the spirit and <br /> intent of the ZoninQ Code and Comprehensive Plan of the City. <br /> �. The City Council has considered this application including the findinas and <br /> recommendations of the Planning Commission, reports by City staff, comments <br /> by the applicants and the effect of the proposed variance on the health, safety <br /> and �velfare of the community. <br /> Pa�e 2 of 5 <br />
