MINUTES OF THE REGULAR ORONO CITY COUNCIL <br />MEETING HELD ON DECEMBER 11, 1995 <br />(* #16) PAY REQUEST - OLD CRYSTAL BAY ROAD - 4TH AND FINAL <br />Jabbour moved, Goetten seconded, to approve payment of the 4th and Final Request for <br />Payment in the amount of $15,684.77 to Buffalo Bituminous for work on the Old Crystal <br />Bay Road Project. Vote: Ayes 4, Nays 0. <br />CITY ADMINISTRATOR'S REPORT <br />( #17) ORDINANCE AMENDMENT CONCERNING YOUTH ATHLETIC <br />FACILITIES - REFERRAL TO PLANNING COMMISSION <br />Moorse reported that the Orono Hockey group is proposing an amendment to the R1-A <br />Zoning Ordinance to obtain a conditional use permit for a ice rink under the "clubs and <br />camps section of the code, which is a less intense use than what an ice arena would be. <br />Staff proposes amending the ordinance to add ice arenas and similar facilities as an <br />accessory use to a school use, so as not to open up an intensive use in the residential <br />zoning district. <br />Jabbour commented that he had thought the school district would be asking for the <br />conditional use permit if necessary. Mabusth said this was not possible under the lease <br />agreement. Jabbour said he had informed the group to make this determination prior to <br />the lease agreement. Mabusth said this was not possible under the lease agreement. <br />• Jabbour said he was uncomfortable with the "club" portion of the ordinance and asked if <br />the use could be isolated under the school use. Mabusth said this is what Moorse was <br />attempting to do with the amendment for youth athletic facilities under the school use. <br />Callahan said the amendment would make this activity related to school use which would <br />make it limited. Jabbour asked if this would allow for such structures being added to <br />other school buildings in the City. Mabusth said the standards would be such that this <br />use could not happen elsewhere. Jabbour reiterated that he would like to see the "club" <br />use eliminated. <br />0 <br />Callahan moved, Goetten seconded, to refer an ordinance amendment, adding Youth <br />Athletic Facilities as an accessory use to a school use, to the Planning Commission for <br />review and recommendation. Vote: Ayes 3, Nays 0. <br />19 <br />
