� o� <br /> � � f ORONO <br /> �6__� � CITY o <br /> �',� �'ti/ RESOLUTION OF THE CITY COUNCIL <br /> t�kESH05�`� NO. 3 6 3 �5 <br /> CONCLLSIONS, ORDER AND CONDITIONS <br /> Based upon one or more of the above findings, the Orono City Council hereb�� <br /> grants a variance to Municipal Zonin� Code Section 10.�6, Subdivision 16 (J-2) and a <br /> conditional use pernut per Section 10.03, Subdivision 19 and 10.56, Subdivision 13 (A&B) to <br /> allow the e�cavation of 34 cubic yards and the filling of 8 cubic ��ards of clean fill to allo��v <br /> the alteration of a lal:eshore bank at a 3:1 slope, subject to the follow-ing conditions: <br /> l. Erosion control shall remain in place until natural groundcover is restored within <br /> the disturbed area. <br /> 2, Banks are to be installed at a minimum 3:1 slope. <br /> ;. Applicant or applicant's contractor shall be responsible for obtaining a land <br /> alteration permit from the City for the approved land alterations completed <br /> before Council's review. Applicant or applicant's contractor shall pay a penalt-� <br /> permit fee at $1�0.00 ($7�.00 initial, $7�.00 penalty fee). <br /> 4. Authorities granted by this resolution run with the property not with the owner, <br /> but are permissive only and must be exercised by application for a land <br /> alteration permit within one week of the date of Council's approval, or the <br /> special conditions of this resolution will expire on that date (November 20, <br /> 199�). <br /> �. Violation of or non-compliance with any of the terrr.s and conditions of this <br /> resolution shall constitute a violation of the Zoning Code, shall automatically <br /> terminate any authority granted herein, and shall be punishable as a <br /> misdemeanor. <br /> 6, The undersianed applicant has read, understood and hereb�� a�rees to the terms <br /> of this resolution and on behalf of himself, his heirs, successors and assians, <br /> hereby agrees to the recording of this resolution in the chain of title of the <br /> propem�. <br /> Page 3 of 5 <br />
