• <br />MINUTES OF THE CITY OF ORONO PLANNING COMMISSION <br />MEETING HELD ON APRIL 18, 1994 <br />(#2) #1921 MARY A. ULRICH, 1000 LOMA LINDA AVENUE - PRELIMINARY <br />SUBDIVISION <br />Gaffron reviewed the staff report and noted that staff recommended approval subject to the <br />conditions listed in the staff report. <br />Mark Gronberg was present representing the applicant. Peterson asked if the applicant had <br />any problems with any of the conditions and Gronberg responded negatively. Discussion <br />ensued regarding the park dedication fee and Gaffron noted that it would be 8% of the fair <br />market value of the new lot only. <br />Chair Schroeder noted this was a public hearing; no one present wished to speak and the <br />public hearing was closed. Discussion ensued regarding the setbacks from the easement from <br />the ordinary high water mark to avoid problems in the future. <br />It was moved by Lindquist, seconded by Peterson, to recommend approval of #1921 <br />Preliminary Subdivision for Mary A. Ulrich, 1000 Loma Linda Avenue subject to <br />stipulations 1 -11 as listed in the staff report and the addition of #12, to require delineation of <br />the wetland along Loma Linda Avenue. Ayes 6, nays 0. <br />0 (0) #1922 ROBERT AND ELIZABETH MELAMED, 1000 OLD CRYSTAL BAY <br />ROAD SOUTH - PRELIMINARY SUBDIVISION <br />The applicant was not present. Chair Schroeder moved, Lindquist seconded, to recommend <br />approval of #1922 Preliminary Subdivision for Robert and Elizabeth Melamed at 1000 Old <br />Crystal Bay Road, subject to the conditions listed in the staff report. Ayes 6, nays 0. <br />( #4) AMENDMENT OF SECTION 10.56, SUBDIVISION 3 <br />Gaffron reviewed the ordinance criteria and definitions proposed for inclusion in the <br />ordinance. Staff recommended approval of the ordinance amendments. Peterson asked what <br />other cities were doing and Gaffron responded he had not discussed this with any others. He <br />felt that the City needed to have something that would give staff the ability to make a <br />determination without having to resort to litigation to resolve differences of opinion. He <br />noted that the Department of Natural Resources (DNR) was concerned about erosion and <br />protection of the lake shore. Lindquist commended staff on a well - written ordinance. <br />Chair Schroeder opened the public hearing. Beverly and Louis Smerling, 2683 Casco Point <br />Road were present. Mrs. Swirling stated she felt that this was relevant and needed and was <br />glad to see some changes made. She noted they have had a great deal of erosion and have <br />had to build retaining walls on their property to stabilize it. Chair Schroeder noted that <br />drainage was always a concern in the Casco Point area and the Planning Commission is <br />• looking at where it was appropriate to construct houses. <br />2 <br />
