MINUTES OF THE ORONO PLANNING COMMISSION MEETING <br />HELD MARCH 21, 1994 is <br />( #5) DAVID L. AND MARGARET H. VERGEYLE - cont. <br />It was moved by Schroeder, seconded by Lindquist, to approve Application #1909 for David and <br />Margaret Vergeyle, 1485 Green Trees Road, as proposed requiring the approval of variances <br />for the proposed house that will be located within the bluff impact zone with the proviso that the <br />applicants need to make a case to the City Council that there is a compelling reason not to move <br />the house approximately 10' and also recommended approval of up to a 10' street setback <br />variance to accommodate the move of the house. There is to be no further fill to the lakeside <br />of the foundation and the runoff from drains will incorporate appropriate percolation if feasible. <br />Ayes 4, nays 2, 1 abstention. <br />Smith was opposed to approving this application because she was uncertain that leaving the <br />decision up to the applicants as to whether to reposition the house or not was the correct way <br />to proceed. She felt the application was being moved along too quickly. <br />Rowlette understood the investment and redesigns the applicants have worked on but felt part <br />of their problems were related to the design of the house. She thought a different house design <br />with a different driveway approach may help them work within the building envelope. <br />Berg abstained due to a potential conflict of interest. 0 <br />Schroeder noted this was the first application the Planning Commission had dealt with that <br />involved the bluff impact zone. The bluff ordinance made the Vergeyle lot unbuildable. <br />The builder requested that the City advise prospective builders of such ordinances since the <br />Vergeyles had been working on the design of their home for over 1' /z years. He stated 80% of <br />the homes on the lake are built in these zones. Mabusth noted that anytime any of those <br />properties proposed any additions, they would be required to apply for similar variances. The <br />builder felt most of the existing homes did not have erosion problems even though they were <br />built in the bluff impact zone. <br />( #6) #1910 ORONO SCHOOL DISTRICT #278 <br />795 OLD CRYSTAL BAY ROAD NORTH - CONDITIONAL USE PERMIT /VARIANCE <br />- PUBLIC HEARING 8:41 P.M. - 8:55 P.M. <br />The Affidavit of Publication and Certificate of Mailing were noted. <br />Neal Lawson was present representing the school district. <br />Mabusth explained this application involves a request to install a storage shed in the northwest <br />comer of the property noting the applicant was unaware of the required 50' setback and is <br />willing to meet this setback. The applicant is also proposing a bleacher /storage structure along <br />the east side of the property adjacent to the tennis courts. • <br />P <br />
