9 v
MINUTES OF THE REGULAR ORONO COUNCIL MEETING
HELD DECEMBER 14, 1992
EXCESS LIABILITY INSURANCE - CONT.
Barrett explained in the general terms, the City has sovereign
immunity, which has been waived by the State up to a certain Ilmit,
so that the City can be sued for damages up to that amount. If the
City elects to be insured above Ghat amount, then the City would
be waiving the liability so it may actually pay more than the
amount. He opined, the contract appears to indicate the only way
to get coverage is to waive those limits.
It was moved by Callahan, seconded by Butler, to'adopt Resolution
#3216 waiving the monetary limits on Tort Liability established by
Minnesota Statutes 466.04, and directed staff to further explain
this issue-at the next meeting.
