These new plans propose certain features <br /> which would be unapproved encroachments of the Common Area, and these must be <br /> resolved before permits can be issued. Given that this is the third attempt at an <br /> approvable design for this site, at this point I think it is necessary to recap where we have <br /> been with this site, where we are today, and what needs to change in arder to allow <br /> issuance of building permits. <br /> Original Approvals <br /> 1. Per Section 5.10 of the Stonebay Community Master Declaration regarding <br /> Encroachments, certain encroachments of the Common Area are allowed "due to <br /> minor inaccuracies in survey, construction, reconstruction, settlement, movement <br /> or otherwise." Such an easement does not appear to allow an intentional <br /> encroachment that is outside the scope of a "minor inaccuracy" or outside the <br /> scope of one of the listed allowable encroachments. Those listed encroachments <br /> include: <br /> - Roof overhangs that extend no more than 36" beyond the boundary of the <br /> Unit (i.e. 36"past the lot line); � . <br /> - Box windows or cantilevered sections not more than 18" beyond the lot <br /> line. <br /> - Cantilevered deck overhangs not more than 30" beyond the lot line. <br />
