A RESOLOTION FINDING <br /> A HAZARDOOS BDILDING AND <br /> R13QUIRING THE SBCURING AND RBPAIR <br /> OF STRIICTURES AT <br /> 1949 FAG$RNESS POINT ROAD, ORONO <br /> THIS RESOLDTION HEREBY SUPERSEDES <br /> RESOLUTION #2713 <br /> WHEREAS, the City of Orono is a municipal. corporation <br /> organized and existing under the l.aws of the State of Minnesota; <br /> and <br /> WHEREAS, Steven Davis is the fee owner of record of <br /> property located at 1949 Fagerness Point Road, Orono, Minnesota, <br /> herein referred to as "the property", and legall.y described as <br /> follows: <br /> Property Identification Number: 18-117-23 14 0016 <br /> Lots 23 and 24 incl.uding accretions described as follows: <br /> commencing at most northerl.y corner of Lot 24, thence south- <br /> westerly to most westerly corner thereof , thence <br /> southeasterZy at a def lecting angle to the left of 60 <br /> degrees 36 minutes to the south line of under the the Linden <br /> Avenue said point being the actual point of beginning, <br /> thence continued southeasterly on said angle line a distance <br /> of 61. 05 feet thence northeasterly to a point in the <br /> extension southerZy of east line of Lot 23 distance 57.05 <br /> feet south from south line of under the Linden Avenue thence <br /> northerl.y along east line of Lot 23 extended to south line <br /> of said avenue, thence westerZy along said south Iine to <br /> beginning, Fagerness, Hennepin County, Minnesota; and <br /> WHERBAS, the City Council of the City of Orono, having <br /> dul.y considered the matter pursuant to Minnesota Statutes <br /> Sections 463.15 to 463.261, hereby finds that the above described <br /> property is uninhabitable and contains unsanitary and hazardous <br /> conditions which constitute a publ.ic nuisance and which makes <br /> this property hazardous to the public heaZth, safety and weZfare <br /> based on the foll.owing findings: <br /> 1. Basement wall backplastered over dirt for foundation <br /> waZ]., northwest corner. Three-quarters of northwest wa1Z is <br /> of 2 tier construction and is cracked and severely bowed. <br /> 2 . Basement wall caving in at ceZlar door. <br /> 3 . Improper beam support over doorway in basement. <br /> 4.
