The project was necessitated by the partial failure and <br /> collapse of a long-existing retaining wall on June 26,2012. You and I have discussed more than <br /> once the possible need for an after-the-fact CUP because of the amount of fill used in the project <br /> by the contractor, Landscape Renovations Inc. <br /> Enclosed is the final invoice by LRI dated September 18, 2013, showing a line item for <br /> 45 cubic yazds of soil (black dirt non-pulverized)("Soil 1")and a line item for 15 cubic yards of <br /> soil(garden blend) ("Soi12"). I understand that the City's threshold for obtaining a CUP was <br /> recently raised to 50 cubic yards of fill within 75 feet of public waters. <br /> I have spoken to Bob Palmer,a co-owner of LRI and the project manager on this project. <br /> Bob has advised me that Soi12 is technically not "fill" but a"soil amendment" for the planting of <br /> the perennials on the sloping garden. In addition,Bob estimates that 15 cubic yards of the Soil 1 <br /> were used on the Honours'property adjoining to the south for the installation of new sod and the <br /> repair of tracks left in their yazd by the heavy equipment. <br /> I hope this new data and the revised ordinance will enable us to forgo the CUP <br /> application and process and will be happy to field any other questions you have. <br /> Sincerely, <br /> Thomas L.
