tti • Sec.13.04 RIGHTSOFSUBJECTSOFDATA Subdivision 1. Type ojdata. The rights ojindrvidua!on whom the data is stored or to be src�d shall be as set forth in thrs secfion. Subd.2. Injormation required to be given individuaL An indrvrdual asked to supply private�s confrdenria!dala concerning himselJ shall be rnformed of.• (aJ the purpose and rntended use of the requested data wirhrn the collecting srote a,ancy,polizicnl subdrvision,or statewrde system;(b)whether he may refuse or is legally required to supply the requested data;(c)arry known corsequencP mising from his supplying or refusing to supply prrvate or confrdential data;and(d)the identity of other persons or entrties authorrzed�:state orfederal!mv to receive the data. This requirement shall not apply when an rndivrdual rs asked to supply investigative data,pursuant tc section 13.82, subdivision S, to a law enforcement offrcer. The commrssioner ojrevenue may place the notice required under this subdivision rn the ind;:-..'ual rncame tax or property tax refund instruetions instead of on those forms. Subd.3. Access lo data by individuaL Upon request to a responsible authority,an individual s'r.:l!be r�ormed whether he is the subject of stored data on indrviduals, and whether it is classifred as public,private ar confrdentral. Upon his_c.rther�e�vest,an individua!who is the subject of stored private or public data on rndrviduals shall be shoivn the data wirhout a�ry charge to hin.md,ifhe desires,shall be rnformed of the content and meaning ojthat data. After an rndividual has been shoivn the private data and inforn.�d of its meaning, the data need not be disclosed to him for six months thereafter unless a drspute or actron pursuant to this sectron is pendrng cr addrti�inal data on the individua!has been co!lected or created. The responsible authoriry sha[l provrde copres of the private or public data:�.on requesl by the indrvidual subject oj the data. The responsible authoriry may require the requesting person to pay the actual costs ojmakir.? certify�,mid compiling the copres. The responsible authority shall comply rmmediately,rf possible,with axy request made pursu�::to this subdivision,or tivithin frve days of the date of the request,excluding Saturdays,Sundays and legal holidays,rjimmediate compliance is r.=t possibie. If he cannat comply with the request within that time,he shall so injorm the individual,and may have an additional f:ve days within x'r.=�n to co�lywith the request,excludrng Saturdays,Sundays and legal holidays. Subd.4. Procedure when dala is not accurate or complete.An individual may contest the acn.�:cv or cempleteness ofpublic or private data concerning himself. To exercrse this rrghl, an individual shall notify in wrrtrng the responsibi2�uthorrn describixg the nature of the drsagreement. The responsible authorrty shal!within 30 days either: (a)correct the datafound to be inac:.rate or brcomplete and attempt to nolrfy past recipients of inaccurate or incomplete data,includrng recipients named by the individual;or(b)nor:the indr.-idual that he believes the data to be correct. Data in dispute shall be disclosed only if the indrvidual's statement of disagreement rs in::Jded wi:h rhe disclosed data. The determination of the responsible authority may be appealed pursuant to the provisions of��adminssative procedure act relating to eontested cases.
