MINUTES OF THE <br />ORONO CITY COUNCIL MEETING <br />Monday, March 14, 2016 <br />7:00 o’clock p.m. <br />_____________________________________________________________________________________ <br /> <br />Page 21 of 37 <br /> <br />12. #16-3807 ESTATE DEVELOPMENT GROUP ON BEHALF OF SCOTT FREDRIKSEN, <br />425 AND 595 OLD CRYSTAL BAY ROAD NORTH, AND PID 33-118-23-24-0002, REZONING <br />TO RESIDENTIAL PLANNED UNIT DEVELOPMENT, PRELIMINARY PLAT AND <br />COMPREHENSIVE PLAN AMENDMENT (continued) <br /> <br />As it relates to the rezoning of the property, Staff and the Planning Commission have concluded that <br />RPUD is the appropriate rezoning option for this development and appears to be the only viable option <br />for development of this parcel in the manner proposed by the applicants. <br /> <br />Gaffron noted Staff’s report contains a number of questions relating to the development and the <br />recommendations of the Planning Commission. The developer has agreed to two access points onto Old <br />Crystal Bay Road so there can be cul-de-sacs that do not exceed the City’s restrictions. Gaffron noted <br />there is no access onto Old Highway 12 currently but there may be one in the future if the Dumas <br />property develops, which would be located further west. Gaffron stated this property to the intersection <br />of Wayzata Boulevard is too close to have another access onto Old Highway 12 or Wayzata Boulevard. <br /> <br />The developer has shown the roads extending to the lot line to the west with the idea in the future that the <br />road to the Dumas property will be extended. The plan shows some temporary cul-de-sacs, which are <br />expected to be built, but those cul-de-sacs could be removed if the road continues at some point. Staff has <br />recommended at the end of the road that there be some sort of barrier and signage alerting the residents to <br />the fact that the road may be extended at some point. <br /> <br />In addition, the applicants are proposing to eliminate a very small wetland that is located at the north <br />entrance. The wetland is a low quality wetland and is one that is right where the access has to be across <br />from the accesses to the industrial park. The applicants are proposing to mitigate it offsite with wetland <br />credits and are working with the Minnehaha Creek Watershed District. There will be a wetland buffer for <br />the other wetland as well as three areas of stormwater management. <br /> <br />Gaffron stated one of the questions that came up during the Planning Commission meeting was the <br />separation between the proposed buildings. The recommendation was to make it a 7.5-foot setback on <br />each side where there is a 5-foot against a 10-foot. Other setbacks between buildings throughout the <br />development are 15 feet and 20 feet, which results in a variety of setback differences. <br /> <br />The proposed development shows a sidewalk on one side of the public road continuing to the cul-de-sac <br />and then up to the intersection. The intersection has stripped crosswalks on all four sides, with a public <br />trail extending down the east side of Old Crystal Bay Road all the way down to the Luce Line. The <br />Planning Commission questioned whether there should be a connection with a sidewalk and then a <br />crossing point so there is an alternate for crossing Old Crystal Bay Road. After discussing the matter, <br />both the applicant and the Planning Commission felt a mid-block crossing was not necessary and would <br />likely create issues. <br /> <br />Gaffron stated the Council should discuss the application, and based on Council direction, Staff will put <br />together either an approval or denial resolution for Comprehensive Plan Amendment. Gaffron noted the <br />rezoning would not occur until final plat approval. <br /> <br />Tom Gonyea, Estate Development, stated he hopes they have come up with a plan that is reflective of the <br />Council’s and Planning Commission’s direction.
