," • . • �� Sec.13.04 RIGHTS OF SUBJECTS OF DATA '� Subd. 1. Type of data. The rights of individual on whom the data is stored or to be stored sttall be as set forth in this section. � � Subd.2. 7nformatIoa reqidred to be given lnd;v;dual, qnindividual asked to supply private or confidential data concerning himself shall be informed of: (a)die purpose aad intended use of the requesced data widun the collecting stace agency,polidcal subdivision,or statewide system;(b)whether he may refuse ar is legally required to supply the requested data;(c)any Imown consequence arising from}ris yvpplying or reCusing to svpply private or confidenaa!data;and(�d�e identiry of other persons or enaaes audiorized by state or federal law to receive the data. T6is requirement shall not apply when an individual is asked to supply investigative data,punuant to secdon 13.82, subdivision S, to a law enforcement officer. Access to data by indivIdual. Upon request to a responsible authority,an individual shall be informed whether he is the subject of stored data on individuals,and whether it is classified as public,private or confideatial. Upon his fiirther request,an individual who is the subject of stored private or public data on individuals shall be shown the data widiout any charge to him and,if he desires,shall be informed of the content and meaning of that data. After an individual has been shown the private data and informed of itc meaning,the data need not be disclosed w him for six mond�s thereafter unless a dispute or action pursuant to this section is pendin$or addidonal data on the individual has been collected or created. The responsible authority shall provide copies of the private or public data upon request by the individual subject of the data. The responsible authoriry may require the requesting persan co pyy the actual costs of making,certifying,and compiling the copies. The responsffile authoriry shall comply immediately,if possible,with azry request made pursuant co this yubdivisioa,or within five days of the date of the request,ezcluding Saturdays,Sundays and legal holidays,if immediate compliance is not possible. If he cannot comply with the request within that time,he shall so inform the individual,and may have an addiaonal five days within which to comply wi�the request, excluding Samrdays,Sundays and legal holidays. Subd.4. Pracedure when data is not accurate or complete. An individual may contest the accuracy or completeness of public or Pnvate dam coaceminS himself. To exeroise�is ri�ht,an individual shall nodfy in writing the responsible authoriry descnbing the�nature of the disagreemeiu. The responsble authoriry sha11 wittun 30 days either. (a)correct the data found ro be imaccucate or iacomplete and attempt to nodfy past recipients of inaccurace or incomplete data,including recipients named by��dual;or(b)nodfy the individual that he believes the data to be correct. Dara ia dispute shall be disclosed only if the individual's statement of disagreement is included with the disclosed data. The determinaaon of the responsible authoriry may be appealed pursuanc W che provisions of the administrative procedure act relating to contested cases.
