__.�___....._ _._. <br /> __ __. _..._ ,_ _ --.__� ___ -- _ ._ _. <br /> � � � - <br /> cit� o� oR,oNo <br /> `'• RESOLUTION OF THE CITY COUNCIL <br /> � NO. 2165 <br /> � <br /> ' • � • • <br /> A RESOLDTION VACATING AN DNUSED PORTION <br /> OF A DEDICATED DRAINAGE AND OTII�ITY EASEMENT <br /> AT 793 AND 795 NORTH FERNDALE ROAD <br /> WITHIN THE PLAT OF BROORS GREEN <br /> SECTION 36, TOWNSHIP 118, RANGE 23 <br /> IN THE CITY OF ORONO, MINNESOTA <br /> FILE NO. 1115 <br /> WHEREAS, the City of Orono is a municipal corporation <br /> organized and existing under tY�e laws of the State of Minnesota; and <br /> WHEREAS, on February 9, 1987, Paul & Virginia Boyke filed a <br /> petition with the City of Orono requesting vacation of a portion of <br /> drainage and utility easements orginally dedicated within the plat of <br /> Brooks Green, legally described as follows: <br /> per Exhibit A, attached; and <br /> WHEREAS, after due published and posted notice, a public <br /> • hearing was held before the Planning Commission on March 16 and April <br /> 20, 1987, regarding said vacation and all persons interested were <br /> given an opportunity to be heard; and <br /> WHEREAS, after due standing and consideration, the Planning <br /> Commission recommended approval of the requested vacation and the <br /> Council of the City of Orono finds that said vacation, as proposed, is <br /> in keeping with the public;.interest in consideration of the following <br /> findings: <br /> � 1. The vacation does not affect access to or use of any <br /> adjoining property. <br /> 2. The City has not and does not intend to develop, improve or <br /> use the portion of dedicated drainage and utility easement <br /> described above. <br /> 3. The portion of dedicated drainage and utility easement as it <br /> exists serves no public purpose. <br /> � 4. The portion of dedicated drainage and utility easement, as a <br /> result of the replat of Brooks Green will no longer coincide with <br /> the boundary between the properties at 793 and 795 North Ferndale <br /> Road. <br /> Page 1 of 2 <br /> • <br />
