. �� <br /> � ! <br /> z § 11. 10 ' <br /> � <br /> SEC. 11.10. SQBDIVISION APPLICATION PROCEDQRE, APPROVAL r <br /> PROCESS, AND REQQIREA'fENTS. L <br /> Subd. 1. Restrictions on Development Prior� to Final Plat r <br /> Approval. Once a preliminary plat has been submitted to the City, � <br /> no building permits will be issued by the City for the construction <br /> of any building, structure or improvement to the land or to any lot <br /> in the proposed subdivision until all requirements of this Chapter � <br /> have been fully completed including the official recording of the <br /> final plat, or until the application is formally withdrawn by the <br /> subdivider. When specifically authorized by this Chapter and r <br /> specifically approved by the Council, permits may be issued for the L <br /> construction of certain improvements such as roads, utilities and <br /> drainage structures. <br /> Subd. 2. Coordination of Flexible Zoning App�ication � <br /> With Subdivision Approval. <br /> A. Intent. It is the intent of this Chapter that � <br /> subdivision review be carried out simultaneously with the review of <br /> flexible zoning applications. <br /> B. Fees. Whenever a proposed subdivision includes (� <br /> a use of land requiring flexible zoning approval, the subdivider � <br /> shall file the separate flexible zoning applications and pay all <br /> � required fees concurrent with the filing of the Preliminary Plat � <br /> application. <br /> C. Review. Review of the flexible zoning <br /> application shall be concurrent with review of the Preliminary Plat <br /> and any flexible zoning approval shall be contingent upon approval � <br /> and subsequent recording of the Final Plat. <br /> Subd. 3. Official Submission Dates, � <br /> A. For the purpose of this Chapter a subdivision <br /> application shall be preliminarily approved or disapproved by the <br /> City within 120 days following the delivery of an application � <br /> completed in compliance with the City Code by the applicant to the <br /> City, unless an extension of the review period has been agreed to <br /> in writing by the applicant. _ � <br /> � J'— B. When a d vision or subdivision to which the <br /> regulations of the City do not apply is presented to the City, the <br /> Clerk of the City shall within ten days certify that the � <br /> subdivision regulations of the City do not apply to the particular <br /> d i v i s i on. ---- - ------ -- --- - I <br /> I _------�---- -- <br /> -------- ----- � <br /> C. If the City or the responsible agency of the <br /> City fails to preliminarily approve or disapprove an application <br /> within the review period, the application shall be deemed � <br /> preliminarily approved, and upon demand the City shall execute a <br /> certificate to that effect.
