This property is approximately 7 acres in area and is located within Orono's RR-lA <br /> Rural Residential Zoning District. <br /> The RR-lA District requires a minimum lot size of 5.0 acres. Any proposed subdivision of property in the <br /> RR-lA District must result in conforming 5-acre lots. Your suggestion of subdividing in a manner that <br /> would place the existing residence and outbuildings on a new 2-acre parcel and leave a 5-acre vacant parcel, <br /> cannot be approved, because the 2-acre parcel would not meet the 5-acre minimum area requirement. <br /> You and I discussed the possibility of a lot line rearrangement that would leave the existing residence and <br /> outbuildings on a 5-acre parcel, allowing sale of the remaining two acres to an abutting property owner for <br /> legal combination with his/her land. This option only works if one of the abutting neighbors is a willing <br /> purchaser. <br /> You did ask about the possibility of a lot area variance. Lot area variances for new subdivisions are virtually <br /> never approved by the City Council,and this property does not e�chibit any unique circumstances that might <br /> lead to such approval. The fact that the Shemanek's owned this property prior to the 1975 City-wide <br /> rezoning does not give it any grandfather rights; if it had existed as two conforming tax parcels prior to that <br /> rezoning and had remained as two tax parcels since then, it might have been eligible for a lot area variance <br /> for an existing lot.
