A residence and accessor} structures have existed on the property for many
years. The oversized barn is covered under an existing Oversized Accessory
Structure Ab eement which was filed against the property.
c. Although it is located ahead of the new home, the existing detached arage is
located 23 feet from Chippewa Lane and will not negatively impact the
cun-ent streetscape.
d. With the exception of the requested variance for location ahead of the
pincipal building, the arage complies with all front yard, side yard, and rear
yard setback requirements.
e. The two smaller accessory buildins along the west property line will be
removed.
4. The City Council has considered this application including the findings and
recommendation of the Planning Commission, reports by City staff, comments by
the applicants and the public, and the effect of the proposed variance on the
health, safety and welfare of the commuiuty.
5. The City Council finds that the conditions existing on this property are peculiar to
it and do not apply generally to other property in this zoning district; that granting
the variance would not adversely affect traffic conditions, liht, air nor pose a fire
hazard or othei- danger to neiahborinQ property; would not merely serve as a
convenience to the applicants, but is necessary to alleviate a demoiistrable
hardship or difficulty; is necessary to preserve a substantial property riglt of the
applicants; and would be in keepin with the spirit and intent of the Zoning Code
and Comprebensive Plan of the City.
CONCLUSIONS, ORDER AND CONDITIONS
Based upon one or more of the above findings, the Orono Cify Council hereby grants a
variance to Orono Municipal Zonilg Code Section 78-1435 to allow the existing detached
arae to remain located between the street and the proposed home, subject to the folloing
conditions:
1. Council approa] is based on the site plan submitted by the applicants and annotated by
City staff, attached to this Resolution as Exllibit A.
