Construction without a proper permit is a violation of City Code Section <br /> 86-66. Furthermore, 4325 Chippewa Lane is located in the RR-1A zoning district which requires <br /> 100' front and rear setbacks and 50' side yard setbacks. The City believes the newly <br /> constructed deck does not meet the required side yard setback of 50'. <br /> This letter will serve as your notice that the property must be brought into compliance <br /> before Thursdav, Auqust 22, 2013. In order to bring the property into compliance the deck <br /> must be removed. <br /> If you are interested in requesting City Council approval to allow the deck to remain in a non- <br /> conforming location, you must apply for an after-the-fact variance. A variance application fee is <br /> $700 and an after-the-fact variance requires a double fee for a total of $1,400, plus a $2,500 <br /> escrow. The application fees are not refundable. Attached is a copy of the variance application. <br /> If a variance is being pursued, a variance application must be received before Wednesday, <br /> August 21, 2013. If an after-the-fact variance is not applied for, the deck must be removed <br /> by Thursday, August 22, 2013. <br /> I have attached the pertinent City Code for your reference.
