Sec.13.04 RIGFTTS OF SUB.TECTS OF D�T� Subd. 1. Type of data. The rights of individual on whom[he data is stored or co be stored shall be as set forth in this secrion. Subd.2. Information reqirired to be given individual. An individual azked to supply private or confidenrial data conceming himseif shall be informed of: (a)the purpose and in[ended use of the requested data within the collecting"state agency,polidcal subdivision,or statewide system; (b)whether he may refuse ot is legally required�o supply the requested data;(c)any lrnown consequence arising from tus supplying or refusing to supply privace or confidenrial data;and(d)rhe idenriry of ocher persons or entides authorized by state or federal law to receive the data. This requ'uement shall not apply when an individual is asked to supply invesrieadve dara, pursuant to secrion 13.82, subdivision 5, to a law enforcemen[ofFicer. T1te commissioner of re�enue mav place the nodce reouired under this subdivision in the individual income tax or propem tax refund instructions inscead of on those forms. Subd. 3. Access to data by individual. Upon request to a responsible authoriry,an individual shall be informed whether he is the subject of stored data on individuals, and whether it is classified as public, private or confidendal. Upon his further request,an individual who is the subject of stored private or public data on individuals shall be shown the dara wichout any charge to him and, if he desires, shall be informed of the content and meaning of rhat data. After an individual has been shown�he private data and informed of iu meaning, che data need not be disclosed to him for six months thereafter uriless a dispute or acrion pursuant to [his secrion is pending or addidonal data on the individual has been collected or created. The responsible authority shall provide copies of the priva[e or pubiic da;a upon:equest by tt:e ir.divid��J suhject of the data. The responsible authoriry may require the requesting person to pay the actual costs of making, cerrifying,and compiling che copies. The responsible au�horiry shall compiy immediately, if possible, wich any request made pursuant to this subdivision,or within five days of the date of the request,excluding Sacurdays,Sundays and legal holidays,if immediate compliance is noc possible. If he cannot comply with the requesc within that time,he shall so inform the individual,and may have an addidonal five days within which to comply with the request,excluding Saturdays, Sundays and legal holidays. Subd.4. Procedure when data is not accurate or complete. An individual may contest the accuracy or completeness of public or pri�•ate data conceming himself. To exercise this right,an individual shall norify in wri[ing the responsible authority describing[he nature of the disagreement. The responsible authoriry shall within 30 days either. (a)cortect the data found to be inaccutate or incomplete and attempt to norify past recipients of inaccurate or incomplete data, inciuding recipients named by the individual; or(b)nodfy the individual that he believes the data to be correct. Data in dispute shall be disclosed only if the individual's statemenc of disagreemenc is included with the disclosed dara. The decerminarion of the responsible authoriry may be appealed pursuanc to the provisions of the administrarive procedure act reladng to con[ested cases.
